Elkins, P.L.C. has been involved in the development of many of the largest commercial and residential real estate projects in New Orleans and has also represented clients developing commercial and residential real estate projects nationwide. These projects involve real estate acquisitions, bond and conventional financing, tax planning, tax credits, partnership law, historic preservation law, façade easements, zoning and title problems and long-term leasing.

The firm's attorneys represented the City of New Orleans in the initial financing of the New Orleans Convention Center. Additionally, members of the firm were on the legal team representing Louisiana World Exposition, Inc. (1984 World's Fair) and were instrumental in the leasing and assemblage of the Fair site. After the Fair, they represented a national retail development company in the development of The Riverwalk, working closely with the City of New Orleans, New Orleans Dock Board and New Orleans Exhibition Hall Authority to structure a complex lease/ownership structure involving public entities and private developers.

Additionally, the firm has acted as counsel for both issuers and underwriters with respect to the syndication of more than $1 billion of equity and associated debt offerings, including most of the residential developments in the historic Warehouse District in New Orleans, a number of which have been nationally syndicated. The firm has also represented several national equity investment funds, which invest equity dollars in real estate investments throughout the country, with respect to tax, real estate and due diligence matters. The firm also represents corporate and institutional investors in direct investments in real estate and tax advantaged properties, including both historic and affordable housing.

Over the past decades, the City of New Orleans has experienced significant growth in the hospitality industry, with a growing need for additional hotel rooms to meet the needs of an expanding business sector. Elkins, P.L.C. has acted as legal counsel in the development of new hotel projects, both locally and, as special counsel, on a national basis, with our practice including real estate acquisition, construction, financing (with particular experience in available subsidy programs, federal and local economic development assistance, community development districts, economic development districts and tax increment and bond financing, including payments in lieu of taxes (“Pilots”)), as well as the negotiation and documentation of management and operating agreements with national hotel operators.

Elkins, P.L.C. is experienced with respect to condominium development. The firm has prepared condominium documents for a wide variety of condominium projects, from residential developments to large-scale commercial and mixed-use developments. Some of the recent residential condominium projects in New Orleans with which the firm has been involved include St. Elizabeth Condominiums, 1205 St. Charles Condominiums and the former Krauss Building in New Orleans. The firm has also structured complex condominium regimes for commercial and mixed-use residential developments, such as the World Trade Center in New Orleans, St. Joe Lofts in New Orleans, the Cotton Mill Apartments in New Orleans, the Ritz-Carlton Hotel in New Orleans, the Humble Oil Building in Houston, the Gateway Renaissance Hotel in St. Louis, the Miller & Rhoads Building in Richmond, Virginia and the Commerce Building in New Orleans. The firm’s service does not stop once the condominium regime is in place; Elkins, P.L.C. represents condominium associations and condominium property management companies in all aspects of development.

The lawyers of Elkins, P.L.C. have experience representing both landlords and tenants in a wide range of leasing matters in the retail, hotel, office, and other commercial areas. The firm’s attorneys also have substantial experience in retail shopping center developments, representing local shopping centers in real estate, leasing, organization, tax, acquisition and financing matters.

Elkins, P.L.C. has significant experience in the acquisition, development, financing and syndication of both market rate and affordable housing for low and moderate income families, as well as the elderly and handicapped. Many of these projects involve utilization of tax exempt financing, federal and state historic and low-income housing tax credits, and often utilize financing through HUD and Rural Housing Service programs, including the redevelopment of public housing under the HOPE VI program. In addition to a heavy concentration of projects in the New Orleans area, the firm represents a statewide real estate client base and serves as special counsel to a nationwide real estate client base. The firm’s clients include developers, investors, syndicators, lenders and not-for-profit entities active in the housing area.
