There are times when the practice of intellectual property law involves more than the usual registration of marks or even the more complex protection of marks against infringement.

As construction commenced, the developer of the American Can Apartments wanted to pay homage to the prior occupants of the building it had rehabilitated by continuing to use the name of the local landmark.

In order to do so, many hurdles would have to be jumped. This included not only approval by the United States Patent and Trademark Office, but one that proved more difficult: the American National Can Company, the entity that resulted from the acquisition by National Can Company of American Can Company.

Eventually, Elkins, P.L.C. was able to work with the successor of the prior owner of the name to allow its continued use as a commitment to its heritage, and the American Can Apartments live on today.
